These Terms of Use (“Terms”) govern your access to and use of V8Y’s public websites, landing pages, and related marketing channels (collectively, the “Sites”). Separate terms apply if you enter into an agreement for V8Y products or services.

Acceptance

By accessing or using the Sites, you agree to these Terms. If you do not agree, do not use the Sites.

Changes

We may modify these Terms at any time. The “Effective date” at the top will change when we do. Continued use after changes constitutes acceptance of the updated Terms.

Permitted use

You may use the Sites only in compliance with applicable laws and these Terms. You agree not to misuse the Sites, including by attempting to gain unauthorized access, disrupting operation, scraping in violation of our rights or robots instructions, or using the Sites to distribute malware or unlawful content.

Intellectual property

The Sites and their content (including text, graphics, logos, and design) are owned by V8Y or its licensors and are protected by intellectual property laws. Except for temporary browsing copies, no rights are granted except as expressly stated.

Third-party links

The Sites may link to third-party websites. We are not responsible for third-party content or practices; use them at your own risk.

Disclaimer

The Sites and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, V8Y and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Sites. Our aggregate liability for any claim relating to the Sites is limited to fifty U.S. dollars (USD $50) unless applicable law requires otherwise.

Indemnity

You agree to defend and indemnify V8Y against claims arising from your violation of these Terms or misuse of the Sites, to the extent permitted by law.

Governing law

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your jurisdiction apply.

Severability

If any provision is held invalid, the remaining provisions remain in effect.
